A: Not really. You can either lay it flat, like on a shelf, or it balances on your tv. The updated camer and it's holder work better for such. as it sits in a curved tray like thing and you can point the camera itself down.

A: Yes it did for me although it would really depend on the seller. Can never be sure unless stated.
