I just received this hammer. it has stickers saying, "hammer for wooden stakes." so this isn't a rock hammer? i think the lawyers have gone too far.

It is a rock hammer. I don't remember seeing that sticker. I recall a sticker that said the sharp end was for prying, not hitting. I use it for surveying as a hammer and digging up ground with the sharp end disregarding the sticker. As for quality, this is a good hammer. Weather for using as a rock hammer or other uses.

Will thise bust up slate or red clay rock swinging the pointed end ?

Estwing actually states that you're not to use the pointed-tip to strike rock. We all do though. The 24oz head gives you more angular force on the strike. More weight and the end. I think I'd consider adding a chisel rather than using the pointed-tip. First for better control as you're placing the chisel where you want the force. Second for safety. I'd go with a Estwing 3/4 in x 9 in Cushion Grip Rock Chisel ERC-9C. Estwing Supreme Big Face 24 oz Pointed Tip Rock Hammer E6-24PC is a good general purpose solution, with the chisel, but if it's a dedicated purpose I'd use a Estwing Supreme 3lb Crack Hammer B3-3LB or Estwing Supreme 32oz Cross Peen Hammer E6-32CP. The like the 32CP for the "thick" chisel-edge.
