Will the small fit my 3 and a half yr old who wears 3t in pants and shirts or would he need toddler?

This 3-4 year size should fit your 3 y/o toddler. I bought the same size to fit my 3 y/o grandson. The hat might be a little large but it will still look adorable. The backpack that comes with the costume can be used as the candy bag.
