how deep is the water?

I would say less than 6". This is a terrible piece. It is made very poorly. Cheap. I used it for less than a month and sold it at a garage sale for $5. Very displeased.

Do the ground stakes come with it?

Yes, it comes with 2 ground stakes.

It says you can put sand in the base, how is that, the base is not enclosed? Puzzled!

You can put sand in the pole before you screw it onto the base. It also comes with stakes to secure to the ground. I have been very happy with mine and did not need to weigh it down with sand. The birds love it !!!!!

I'm not sure about painting it. I would be afraid that the paint could hurt the birds! I do like this bird bath very much and so do the birds. I have many visitors for water every day!!!
